Something like legal stuff to talk about, but it’s cool:
- All I am doing is providing the design, and I make no guarantees or promises about the elements (photographs, drawings, graphics, etc) outside those that I claim as my own, which I will include in some designs as royalty-free, no attribution for photo/graphic required.
- I’m not a lawyer and I cannot give legal advice, so if you need that you should definitely get a lawyer.
- If you purchase a cover design by Rachael you will get the quality sized files necessary to use your cover design however you need in relation to marketing (e.g. as signage, bookmarks, business cards, ads, promos, whatever you want). There are some limitations to this, but nothing out of the ordinary. See the T&C for more info.
- Limitations on photo use in cover designs
- Using any visual content in a pornographic, defamatory, or deceptive context, or in a manner that could be considered libelous, obscene, or illegal.
- Portraying any person depicted in connection with a sensitive use, such as depicting such person: in any manner in connection with pornography, “adult videos”, adult entertainment venues, escort services, dating services, or tobacco products; as endorsing a political party, candidate, elected official, or opinion; as suffering from, or medicating for, a physical or mental ailment; or engaging in immoral or criminal activities.
- I’m sure there’s some other legal mumbo jumbo I’m supposed to have here, but I’ll just say use common sense. If it’s not your photograph and it’s not public domain/CC0 or you’re not sure, get written permission from the photo owner. And like we say about questionable food items in the fridge: If in doubt, throw it out! Don’t use it. If there is a person or people clearly depicted, make sure that whoever it is (the model) has given written permission for use to you or your photographer. There are even rules for buildings, art, etc! You must also get permission before using certain photos of this nature in your cover (and I don’t always know which buildings etc. are considered trademarked or copyrighted, so that’s up to you to verify).
